No Excuses Service Agreement

This service agreement is between No Excuses Web Design of Kingsport, TN and _________________________________, to be referred to as "the client" from this point forward.

All Web site services offered by No Excuses Web Design (referred to as N.E.W.D. from this point forward) are offered under the following written and signed agreement which is by signature, agreed upon to be legal and binding in the court of law as permitted by the laws governing TN, USA.  It is understood that the client will receive full customized Web services, complete with domain name, hosting resources, Web design and and one hour of webmastering (for updates) each month, inclusive of their monthly fee as outlined on the N.E.W.D. Web site and in this agreement.

It is understood that N.E.W.D. is effectively building and managing  the client Web on a two year payment plan.  That the client will be obligated by the terms in this agreement, to pay the abovementioned monthly fee for a minimum term of two years from the date of this agreement, and that the domain name which we purchase in conjunction with your account will remain under our control for the term of this agreement.  It is further understood that after a two year term is met, that the monthly fee can be replaced by standard hosting charges (dependent on your resources only) or by one of our managed plans (with non hosting related tech support and updates).  

The client acknowledges that they must conduct business under the terms of our AUP (Acceptable Use Policy) and our TOS (Terms of Service), both found on our Web site at www.noexcuses.biz/aup.html and www.noexcuses.biz/tos.html respectively.  The client is encourage to read our entire AUP and TOS, but at the very least familiarize themselves with our zero tolerance stance on SPAM E-Mail practices, as this is the single most violated regulation for any hosting business.

By signing and dating this agreement the client acknowledges that they understand all of the terms therein and that they agree to abide by them, and that violations of this agreement and supporting TOS and AUP are grounds for immediate termination of services without refund.  Further, it is understood that upon termination of a contract due to breach of TOS or AUP, or by means of the client will warrant the immediate payment of the balance of the contract in full for Web design services rendered.
